YYM Group General Building Contracting Co. W.L.L. (the Agent) acts as commercial agent of Itinera S.p.A and the potential exposure, under applicable law, by the Agent’s General Manager Mr. Yousef Al Matrouk (Mr. Al Matrouk) to personal (civil and or criminal) liabilities in relation to municipal violations concerning the project’s temporary building areas (including offices, storage, central mixers, asphalt factory, and workers rest areas) (collectively, the Indemnified Matters) under the contracted (the Contract) entered into by Itinera S.p.A

Itinera, a large-scale construction company controlled by the ASTM Group and among the major national players in the construction of large infrastructure projects, has been awarded the contract for the upgrading of the Abdaly Highway in Kuwait worth about E274 million euros.

The Abdaly Highway currently links Kuwait City with the city of Abdaly. Specifically, the project involves the modernization of the highway along a stretch of 25 km by transforming the existing two three-lane roadblocks into a new highway with five lanes and one emergency lane for each roadway.

The project – promoted by Kuwait’s Ministry of Public Works – aims at creating the right type of access to the new residential town under construction in South Al Mutla, about 40km northwest of Kuwait City.

The contractor is responsible to perform survey, inspections and investigations of the existing utilities along or crossing the road and must contact ministries, authorities and companies and obtain the necessary information to determine the exact locations which shall be affected by the contractor’s works.

The contractor shall be responsible regarding any damage for the existing utilities of what so ever nature. Any information made available to the contractor either in these documents and contract drawingsor by any other source shall not relieve the contractor of his responsibilities either to protect or to relocate the existing utilities.

The contractor shall submit a report to the Engineer indicating any interference of these utilities with the required construction works and the proposed date to remove these utilities.
The contractor in conjunction with all owners of the utilities shall locate, stake and mark on site all utilities ,which located on or adjacent to the proposed work.
The contractor shall notify all the Authorities of these utilities in writing prior to approach their utilities or entering their right-of-way of 21 days period.

The contractor is responsible either to divert ,relocate or to protect the existing utilities of whatsoever nature in coordination with their Owners (Ministries , Authorities and Companies)
